The state's highest court has dismissed Hornblower Cruises' lawsuit challenging the state's 2012 deal with the Maid of the Mist Corp. that allowed the company to build a winter storage facility for its boats in the Niagara Gorge.
The Court of Appeals on Thursday released its decision in the case, which was brought in early 2013. In their suit, Hornblower officials asserted the agreement was made without a fair and equitable bidding process.
Hornblower, which started operating boat rides below the falls from Niagara Falls, Ont., last year, had appealed lower court decisions that came out in the state's favor.
Construction of the facility, on the site of the former Schoellkopf Power Station on the American shores, was completed near the end of 2013.
