12-27-24 CORPORATE TRANSPARENCY ACT (“CTA”) TEMPORARILY BLOCKED AGAIN

The Fifth Circuit Court of Appeals previously granted the government’s emergency motion to stay the federal district court’s nationwide preliminary injunction. Yesterday a different panel of the Fifth Circuit, which will handle the merits of the appeal, reversed course and reinstated the nationwide preliminary injunction pending appeal. Accordingly, the government is prevented from enforcing the CTA and reporting companies are not currently required to comply with the CTA’s pending filing deadlines.

The case is Texas Top Cop Shop v. Garland, 5th Cir., No. 24-40792, order 12/26/24, available at https://www.ca5.uscourts.gov/opinions/unpub/24/24-40792..pdf.

We are prepared to help your company navigate the CTA’s reporting requirements.
