1-23-25 SUPREME COURT ALLOWS THE CORPORATE TRANSPARENCY ACT (“CTA”) TO RESUME
Today, the Supreme Court granted the government’s appeal of the nationwide preliminary injunction on CTA enforcement. The injunction is stayed pending: (i) the Fifth Circuit Court of Appeals’ disposition of the government’s initial appeal and (ii) the Supreme Court’s decision on whether to grant certiorari. Accordingly, the government is now free to enforce the CTA and all reporting companies must comply. It remains to be seen whether FinCEN will issue extended filing deadlines.
